By filling out the web form, you confirm that you are familiar with these Rules, that you express your consent to their wording, and that you accept them in full.

Reason, Scope and Purpose of Processing Personal Data

1. The controller of your personal data according to Article 4(7) of Regulation (EU) 2016/679 of the European Parliament and of the Council on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter: "GDPR") is Miroslava Pivrncová (hereinafter referred to as the CONTROLLER).

2. Personal data means any information about an identified or identifiable natural person; an identifiable natural person is a natural person who can be directly or indirectly identified, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.

3. The controller has not appointed a data protection officer.

4. The controller processes your personal data that you have provided or personal data that the controller has obtained based on your completion of orders or other relevant forms.

5. The controller processes your identification and contact data and data necessary for the performance of the contract, i.e., first name, last name, email address, telephone number and, if necessary, also company ID, VAT number, registered office address or place of business.

6. The legal basis for processing personal data is:

  • performance of a contract between you and the controller according to Article 6(1)(b) GDPR,
  • your consent to processing for the purposes of direct marketing (especially for sending commercial communications and newsletters) according to Article 6(1)(a) GDPR in conjunction with Section 7(2) of Act No. 480/2004 Coll., on certain information society services, in the event that no order for goods or services has been placed.

7. The purpose of processing personal data is:

  • processing your order and exercising the rights and obligations arising from the contractual relationship between you and the controller; when ordering, personal data that are necessary for the successful processing of the order (name and address, contact) are required, providing personal data is a necessary requirement for entering into and fulfilling the contract, without providing personal data it is not possible to enter into or fulfill the contract on the part of the controller,
  • sending commercial communications and carrying out other marketing activities.

8. There is no automated individual decision-making on the part of the controller within the meaning of Article 22 GDPR.

9. The controller stores your personal data:

  • for the period necessary to exercise the rights and obligations arising from the contractual relationship between you and the controller and to enforce claims from these contractual relationships (for a period of 15 years from the termination of the contractual relationship).
  • until consent to the processing of personal data for marketing purposes is revoked, but no longer than 5 years.
  • After the expiration of the personal data retention period, the controller will delete your personal data.

Your Rights

Under the conditions set out in the GDPR, you have:

  • the right to access your personal data under Article 15 GDPR,
  • the right to rectification of personal data under Article 16 GDPR, or restriction of processing under Article 18 GDPR,
  • the right to erasure of personal data under Article 17 GDPR,
  • the right to object to processing under Article 21 GDPR,
  • the right to data portability under Article 20 GDPR,
  • the right to withdraw consent to processing in writing or electronically at mirka@pivrncova.com.

You also have the right to file a complaint with the Office for Personal Data Protection if you believe that your right to the protection of personal data has been violated.

Final Provisions

1. By filling out and submitting the order web form or other relevant form and checking the box "I agree with the Rules", you confirm that you are familiar with the personal data protection rules, that you agree with them and that you accept them in full.

2. The controller is entitled to change these Rules. The controller will publish the new version of the Rules on its website and will also send you the new version of these terms to your email address that you provided to the controller.
